1. Subscription Fulfilment Terms and Conditions of Use

1.1. Subscription Description

The paid subscription upgrades the free plan.

1.2. Subscription Payment Options

To subscribe, you can pay using your debit or credit card. We may offer additional payment options based on your location. A third-party PCI-compliant payment gateway securely processes all payments.

We reserve the right to refuse to do business with you or cancel your order at our discretion. The cases where we would need to use such measures are - for example, a suspicion of using our product for illegal purposes and being in breach of our terms and conditions.

1.3. Subscription Purchase Currency

The integrated payment gateway will show currency relevant to your location and account. In Australia, the subscription purchase currency will likely appear in AUD.

1.4. Subscription Fulfilment

The system will fulfil the subscription automatically after accepting your payment.

If you encounter issues after changing your plan, contact us.

We recognise you might change your mind after we fulfil your subscription. If you are unhappy with your subscription, please visit the relevant section about cancellations and refunds.

1.5. Subscription Missed Payments

If you miss a subscription payment - after a grace period, the system will automatically change your plan back to the free one.

2. Subscription Cancellation Terms and Conditions of Use

2.1. Subscription Cancellation

2.1.1. Subscription Cancellation Process

To cancel your subscription and return to the free plan, log in and visit your account details page.

If you cancel before the next billing period, your subscription's benefits will last until its end. Cancel within the billing period to avoid being charged for the next one.

2.1.2. Subscription Cancellation Effects

Once you cancel your subscription and return to the free plan, you can select a project to continue to edit. After carefully choosing your editable project, your other two projects will become view-only.

If your editable project exceeds the number of objects or the total size of reference images uploaded, you must archive some entities before being able to edit again. In case of your subscription renewal, your archived entities will become editable again.

Please note that the effects of cancelling your subscription apply to the billing period after the one paid. Where applicable — your editing rights are revoked as described above.

2.1.3. Subscription Refunds

If you are unhappy with your purchase, you can request a refund in addition to your cancellation. If you find our product unsuitable for your needs, we honour refunds requested only shortly after the start of the billing period.

We recommend trying out the free plan first before commencing a subscription.

3. Security Terms and Conditions of Use

3.1. Subscription Payments Security

We do not store your payment details. A third-party PCI-compliant payment gateway securely processes all payments. You can manage your details, subscriptions, and plans in there.

4. Data Attribution Terms and Conditions of Use

4.1. Data Copyright

Designer's Toolbox uses the following open data:

  • Australia, NSW - Aerial Imagery, Cadastral Data, Contours & Water - © State of New South Wales (Spatial Services, a business unit of the Department of Customer Service NSW). For current information go to spatial.nsw.gov.au.

Usage of data retrieved from Designer's Toolbox - such as Aerial Imagery, Cadastral Data, Contours, and similar:

  • Data can be used for personal purposes or commercial purposes (obtained for your direct clients). Attribution (see above) must be retained.
  • Data must not be retrieved in large quantities e.g. for purposes to be passed into another system.

5. Temporal Data Terms and Conditions of Use

By using the property location or title topographical data look-up, you agree to adhere to the third-party providers' policies. We reserve the right to cancel your account on suspicion of using the feature unethically or to mine data.

6. Project Data Terms and Conditions of Use

6.1. Anonymity of Project Data

We politely request you to omit any specific identifiable details in your projects - like full names and addresses of yours, your clients, friends, or family. We see it as a good security practice.

6.2. Legality of Project Data

You agree not to store or use project data to associate with an illegal venture. We reserve the right to cancel your account on suspicion of using the tool for an illegal or unethical activity.

6.3. Project Data of Inactive Account

We consider your account inactive if you - as its owner, have not used it for two years.

If we recognise your account as inactive, we might contact you to understand if you wish to continue using our product. Devoid of your reply, after a waiting period of 30 days after that event, we will delete your project data.

We consider your account active if you are using the system. An example of an activity is logging in or editing project data.

6.4. Project Data Availability and Retrieval

After your account or your project data has been deleted, we cannot reinstate it.

7. Feedback Data Terms and Conditions of Use

We reserve the right to note down and retain anonymised feedback indefinitely to improve the app and customer experience.

8. Addressed Communication Terms and Conditions of Use

8.1. Addressed Communication Security

When contacting us via an email, post or a media account, please bear in mind there might be impostors using our brand name and that digital communication might not be safe. If you receive communication via a phone or other media not listed on our website, there is a likelihood of being fraudulent. Always refer to our website for contact details. We cannot take legal responsibility for acts of impersonators.

8.2. Addressed Communication Data Deletion

We reserve the right to input your data - email and name - into a customer management system for future reference.

If you decide to delete your account, we will delete addressed data that could identify you within 30 days after the event. You can contact us to request the deletion of your contact data via the same platform you have used to originate our communication on the condition we are managing the account.

Please note the deletion of data you provided via third-party platforms depends on the relevant provider's terms and conditions.

We reserve the right to note down any statistical data about you that you might provide us or your anonymised feedback so that we can continuously improve the customer experience.
